1. About Us & These Terms

These Terms of Service (“Terms”) govern your use of the website loomella.co.uk and any purchase made through it. Please read them carefully before placing an order.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Our registered trading name is Loomella. You can contact us at support@loomella.co.uk.

2. Eligibility

You must be at least 18 years of age and a resident of the United Kingdom to place an order on Loomella. By placing an order you confirm that you meet these requirements.

3. Your Account

You may browse our website without registering. To place an order or access your order history, you must create an account. You are responsible for:

  • keeping your password confidential and not sharing it with anyone
  • all activity that occurs under your account
  • notifying us immediately at support@loomella.co.uk if you suspect any unauthorised use

We reserve the right to suspend or close accounts that violate these Terms, are used fraudulently, or remain inactive for an extended period.

4. Ordering & Contract Formation

All product listings on Loomella constitute an invitation to treat, not a binding offer. A legally binding contract between you and Loomella is only formed when we send you an order confirmation email confirming dispatch.

We reserve the right to refuse or cancel any order before dispatch, including where:

  • a product is out of stock or has been mispriced due to a technical error
  • we suspect fraud or misuse of our service
  • payment authorisation fails

If we cancel your order after payment has been taken, we will issue a full refund within 5 business days.

5. Pricing & Payment

All prices are displayed in pounds sterling (GBP) and include VAT at the applicable UK rate unless stated otherwise.

We take reasonable care to ensure prices are accurate. If we discover a pricing error before dispatch, we will contact you and offer you the option to proceed at the correct price or cancel your order for a full refund.

We accept major debit and credit cards (Visa, Mastercard, American Express) and other payment methods offered at checkout. Payment is processed securely by Stripe. We do not store or have access to your full card details.

6. Delivery

We deliver to addresses within the United Kingdom. Delivery times and charges are displayed at checkout. Estimated delivery times are indicative and not guaranteed.

Risk in the goods passes to you upon delivery. If you are not available to accept delivery, our carrier may leave the parcel in a safe place or with a neighbour and will notify you. You are responsible for collecting the parcel promptly.

If a parcel is lost or damaged in transit, please contact us at support@loomella.co.uk within 28 days of the expected delivery date. We will liaise with the carrier and arrange a replacement or refund as appropriate.

7. Your Right to Cancel (Consumer Contracts Regulations 2013)

If you are a consumer buying goods for personal use, you have a statutory right to cancel your order within 14 daysof receiving the goods, without giving any reason (the “cooling-off period”).

To exercise this right, you must notify us before the 14-day period expires by emailing returns@loomella.co.uk with your order number and a clear statement of your decision to cancel.

The cooling-off right does not apply to:

  • items that are personalised or made to your specification
  • sealed goods that have been unsealed after delivery and are not suitable for return for hygiene or health protection reasons (e.g. pierced jewellery, certain beauty products)
  • perishable goods
  • digital content once downloading has begun (with your consent and acknowledgment that the right to cancel is lost)

8. Returns & Refunds

You must return goods in their original condition and packaging, unused and undamaged, within 14 days of notifying us of your cancellation. Return postage costs are your responsibility unless the item is faulty or was sent in error.

We will process your refund (including the original standard delivery cost) within 14 days of receiving the returned goods or evidence that you have returned them, whichever is earlier. Refunds are issued via the original payment method.

We may reduce your refund to reflect any diminished value of the goods resulting from handling beyond what is necessary to ascertain their nature, characteristics, and function.

Faulty or misdescribed goods: If an item is faulty, damaged, or significantly not as described, you are entitled under the Consumer Rights Act 2015 to a repair, replacement, or refund. Please contact us at support@loomella.co.uk within 30 days of delivery for an immediate right to reject; after 30 days and within 6 months, we are entitled to attempt a repair or replacement first.

9. Product Descriptions

We endeavour to ensure all product descriptions, images, and specifications are accurate. However, product packaging, colours, and minor specifications may vary due to screen calibration or supplier updates. Such variations do not constitute grounds for return unless the product is materially different from its description.

10. Intellectual Property

All content on loomella.co.uk — including the Loomella name and logo, text, images, graphics, design, software, and data — is owned by or licensed to Loomella and is protected by UK and international intellectual property laws.

You may not copy, reproduce, republish, distribute, or create derivative works from any part of our website without our express written consent, except as permitted by law (e.g. for private study or research).

11. Acceptable Use

You agree not to use our website to:

  • engage in any unlawful, fraudulent, or harmful activity
  • impersonate any person or entity or misrepresent your affiliation with any person or entity
  • transmit any unsolicited or unauthorised advertising, spam, or promotional material
  • introduce viruses, trojans, worms, or other malicious code
  • attempt to gain unauthorised access to our systems, servers, or databases
  • use automated tools to scrape, crawl, or extract data without written permission

12. Limitation of Liability

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded under the Consumer Rights Act 2015 or other applicable law.

Subject to the above, our total liability to you for any loss or damage arising out of or in connection with these Terms shall not exceed the total amount paid by you for the order giving rise to the claim.

We are not liable for: indirect, consequential, or special losses; loss of profits, revenue, or goodwill; loss of data; or losses arising from matters outside our reasonable control (see clause 13).

13. Events Outside Our Control (Force Majeure)

We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, government actions, disruptions to third-party carriers, or telecommunications failures. We will notify you as soon as practicable and take reasonable steps to minimise disruption.

14. Third-Party Links

Our website may contain links to third-party websites. These links are provided for convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.

16. Changes to These Terms

We may revise these Terms from time to time to reflect changes in law, our business practices, or other relevant factors. We will give reasonable notice of material changes. Continued use of our website after changes take effect constitutes your acceptance of the revised Terms.
